For marketing calls covered by the Telephone Consumer Protection Act, the burden of proving consent sits with the party making or benefiting from the call. In a call exchange, that means consent evidence has to travel with the lead from the moment of opt-in to the buyer's sales floor.
What a consent certificate shows
Third-party certificates such as TrustedForm certificates and Jornaya LeadiD tokens record the consumer's session on the opt-in page: when it happened, what disclosure language was displayed, and how the consumer interacted with the form.
A practical review checklist for buyers
- Confirm every lead or transfer includes a certificate or token.
- Spot-check that the disclosure shown names your company or a permitted category of sellers.
- Store certificates with your call records for the full retention period your counsel recommends.
- Re-check consent practices whenever regulations or court decisions change.
